By accessing or using the Service, you agree to comply with this AUP and all applicable laws and regulations.This AUP is incorporated into and forms part of our Terms of Service. Capitalized terms not defined herein have the meanings assigned in the Terms of Service.
2. Scope and Application
This AUP applies to all users of the Service, including:
Individual subscribers and trial users
Organization administrators and team members
API users and integrators
Any third party accessing the Service through your account
You are responsible for ensuring that all persons accessing the Service through your account comply with this AUP.
3. Prohibited Uses
You may not use the Service to:

Generate, transmit, or store content that is defamatory, obscene, fraudulent, or otherwise harmful
Create content that promotes violence, discrimination, harassment, or hate speech
Produce content intended to threaten, abuse, or intimidate any person
Generate deepfakes or synthetic media intended to deceive or harm others
3.3 Intellectual Property Violations
Infringe upon any patent, trademark, trade secret, copyright, or other proprietary rights
Upload or process documents you do not have legal authorization to use
Attempt to reverse engineer, decompile, or extract the source code of the Service
Use the Service to build competitive products or services
Scrape, copy, or replicate CaseMark's Easy Button workflows, templates, or proprietary methodologies
3.4 System Abuse and Security
Attempt to gain unauthorized access to the Service, user accounts, or computer systems
Introduce viruses, malware, or any malicious code into the Service
Perform denial-of-service attacks or otherwise attempt to disrupt the Service
Use automated tools (bots, scrapers, crawlers) to access the Service except as explicitly permitted
Circumvent any access restrictions, rate limits, or security measures
Probe, scan, or test the vulnerability of any system or network
Share account credentials or allow unauthorized access to your account
3.5 Fraudulent or Deceptive Practices
Provide false, misleading, or fraudulent information during registration or use
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Engage in phishing, spoofing, or other social engineering attacks
Manipulate usage metrics or billing systems
Create multiple accounts to circumvent service limitations or billing
Use payment instruments you are not authorized to use
3.6 Abusive Service Usage
Use the Service in any manner that exceeds reasonable usage limits or could impair Service functionality
Generate excessive API requests or engage in activity that places unreasonable load on our infrastructure
Use the Service to store or transmit unsolicited marketing communications (spam)
Use the Service primarily for file storage rather than legal workflow processing
Resell or sublicense access to the Service without our express written permission
Use the Service to provide services to third parties in competition with CaseMark
3.7 Regulatory and Compliance Violations
Violate export control laws or regulations
Process protected health information (PHI) outside of HIPAA-compliant mode
Fail to maintain required professional licenses or certifications
Violate attorney professional conduct rules or ethical obligations
Use the Service in a manner that violates data protection laws (GDPR, CCPA, etc.)
3.8 AI-Specific Misuse
Attempt to manipulate or "jailbreak" AI models to generate prohibited content
Use outputs from the Service to train competing AI models
Intentionally generate outputs designed to violate third-party rights
Use the Service to create content that misrepresents AI-generated material as human-created
Attempt to extract or replicate the prompts, instructions, or methodologies underlying Easy Buttons
4. Professional Responsibility
As a legal technology platform, CaseMark users acknowledge:

You remain solely responsible for all legal work product generated using the Service
You must review, verify, and validate all AI-generated content before use
You maintain full professional responsibility for advice provided to clients
You must comply with all attorney professional conduct rules and ethical obligations
You are responsible for maintaining client confidentiality and privilege
4.2 No Legal Advice
CaseMark does not provide legal advice and is not a substitute for professional legal judgment
AI-generated content must be reviewed and validated by a qualified attorney
You may not rely solely on AI outputs for legal opinions or critical legal decisions
4.3 Verification Requirements
You must independently verify all case citations, statutes, and legal authorities
You are responsible for confirming the accuracy and current status of all legal research
You must validate all factual assertions in AI-generated documents
5. Content Standards
5.1 User Content
You represent and warrant that any content you upload, process, or generate using the Service:
Does not violate this AUP or our Terms of Service
Does not infringe any third-party rights
You have all necessary rights and permissions to use
Complies with all applicable laws and professional obligations
5.2 Monitoring and Review
CaseMark reserves the right, but has no obligation, to:
Monitor usage patterns and content for AUP compliance
Review content for security, fraud prevention, and quality assurance
Use aggregated, anonymized usage data to improve the Service
Employ automated systems to detect prohibited activity
We do not proactively monitor the substance of user documents or attorney work product, but may review content when:
Required by law or legal process
Necessary to enforce this AUP
Investigating suspected violations
Responding to user support requests
Protecting the security and integrity of the Service
6. Enforcement and Remedies
6.1 Investigation
Upon receiving notice or becoming aware of potential AUP violations, CaseMark may investigate and determine appropriate action in its sole discretion.
6.2 Suspension or Termination
We reserve the right to:
Immediately suspend or terminate your access to the Service
Remove or disable access to content that violates this AUP
Report violations to law enforcement or regulatory authorities
Pursue any legal or equitable remedies available
We may take these actions without prior notice if we reasonably believe:
You have violated this AUP
Your use poses a security risk or liability to CaseMark or other users
Your use could cause harm to CaseMark's systems, reputation, or business
Required by law or to protect legal rights
6.3 No Refunds
Accounts suspended or terminated for AUP violations are not eligible for refunds of subscription fees or unused credits. Outstanding balances remain due immediately upon termination.
6.4 Repeat Violations
Users with repeated AUP violations may be permanently banned from the Service, and we may refuse future account creation requests.
7. Usage Limits and Resource Allocation
7.1 Fair Use
The Service is intended for legitimate legal workflow processing. CaseMark reserves the right to impose usage limits, rate limits, and resource allocation policies to ensure fair access for all users.
7.2 Excessive Use
Usage patterns that significantly exceed typical user behavior may be deemed excessive and subject to:

Additional charges beyond standard pricing
Account suspension pending investigation
Migration to Enterprise pricing tiers
7.3 Storage Limits
While we provide generous storage for legal matters, we reserve the right to impose reasonable storage limits and may delete inactive matter data after appropriate notice.
8. Third-Party Services and AI Models
8.1 Third-Party AI Providers
The Service integrates multiple third-party AI providers (OpenAI, Anthropic, Google, xAI). Your use of these models through CaseMark is subject to:

9. Data Protection and Privacy
9.1 Data Usage Rights
By using the Service, you grant CaseMark the right to:
Process your content to provide the Service
Use aggregated, anonymized usage data for analytics and improvement
Employ automated quality evaluation systems to assess workflow performance
Store and process content in accordance with our Privacy Policy
9.2 HIPAA Compliance
For matters containing protected health information (PHI):
You must enable HIPAA-compliant mode
Additional restrictions may apply to model selection and processing
You are responsible for properly configuring privacy settings
9.3 Data Retention
We retain data as necessary to provide the Service
Deleted matters may be retained in backups for up to 90 days

10. Intellectual Property Protection
10.1 CaseMark Intellectual Property
The Service, including all Easy Buttons, workflows, templates, prompts, user interface designs, algorithms, and proprietary methodologies, are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.You may not:
Copy, replicate, or recreate CaseMark's workflows or methodologies
Extract or reverse engineer Easy Button prompts or instructions
Use CaseMark intellectual property to create competing services
Remove or obscure any proprietary notices or branding
10.2 User-Generated Content
You retain ownership of your input content and generated work product, subject to the limited license granted in our Terms of Service.Custom workflows and Easy Buttons you create remain your property, but CaseMark may:
Use anonymized versions for platform improvement
Feature exemplary workflows in marketing materials (with your permission)
Analyze usage patterns for quality assurance
11. API and Developer Access
If you access the Service via API or developer tools:

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. CASEMARK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13.2 Service Availability
We do not guarantee uninterrupted or error-free service
The Service may be modified, suspended, or discontinued at any time
AI model availability and performance may vary
13.3 Content Accuracy
We do not warrant the accuracy, completeness, or reliability of AI-generated content
Users must independently verify all outputs
CaseMark is not liable for errors or omissions in generated content
13.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASEMARK'S TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THIS AUP SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO CASEMARK IN THE 12 MONTHS PRECEDING THE CLAIM.CASEMARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
14. Indemnification
You agree to indemnify, defend, and hold harmless CaseMark, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:
Your use or misuse of the Service
Your violation of this AUP
Your violation of any law or regulation
Your violation of any third-party rights
Content you submit, upload, or generate using the Service
Any professional misconduct or malpractice related to your use of the Service
This indemnification obligation survives termination of your account and continues indefinitely.
15. Modification of This Policy
15.1 Right to Modify
CaseMark reserves the right to modify this AUP at any time. Changes will be effective:
Immediately upon posting for material changes affecting security or legal compliance
30 days after notice for other modifications

This AUP is governed by the laws of the State of Delaware, without regard to conflict of law principles.
